Position Overview & Specifications
- Provide legal advice to the FCA on the use of its statutory powers and within a public law framework to assist overseas authorities, to FCA investigation teams on obtaining and using information and evidence obtained from abroad in a wide variety of investigations and in relation to the international disclosure of confidential information and personal data;
- Handle incoming requests for assistance from international regulators, advising on strategy, scope, use of statutory powers and gathering evidence; managing communications with firms and individuals under investigation, their legal representatives and overseas regulators;
- Assist with interviews of witnesses and suspects using FSMA compulsory powers on behalf of overseas regulators;
- Maintain and promote relationships with strategically important international authorities, with the aim that EMO obtains the assistance it needs to deliver its objectives
- Provide specialist legal advice to investigation teams relating to international and domestic cooperation including cutting-edge issues
- Contribute to development of L&I know-how in the team and across EMO

- Qualified lawyer, with a valid practising certificate issued by the Solicitors Regulation Authority for England and Wales (if a solicitor), or the General Council of the Bar for England and Wales (if a barrister) (or a similar internationally recognised qualification)
- Post qualification experience in international investigations, contentious financial services or other regulatory investigations or proceedings
- Experience of managing and progressing a varied caseload
- Ability to analyse complex evidence to form a view as to whether use of FSMA powers is appropriate
- Ability to apply sound principled legal analysis to novel situations
- Ability to think strategically, proactively identifying what needs to be done and exercising judgement to make and enact decisions;
- Ability to work independently with minimal oversight and to work well under pressure
- Taking responsibility for making timely decisions based on relevant analysis;
- Proven relationship management skills to build and maintain effective working relationships with colleagues and with external bodies
- Strong communication skills in order to present the outcome of analysis clearly and effectively, orally and in writing;
- Demonstrated interest in international work and cross-border cooperation
- Sound knowledge of FSMA and the structures, practices and responsibilities of the FCA
- Previous experience dealing with overseas counterparts
- Good working knowledge of GDPR, EU law and criminal law
- This role is graded as practising legal Level 8 Associate.

The salary range is £45,100 - £66,800 plus a competitive benefits packageand non-contributory pension
